I’m glad to see that many auto manufacturers are attempting to develop technology to prevent pedestrian and other types of crashes.  As this incident points out, though, technology should never be used as a substitute for good driving.  Pedestrian accident prevention begins with the person behind the wheel!

Bruce Jenner Files Motion to Try to Dismiss Wrongful Death Lawsuit Against Him

Interesting legal maneuvering is going on in the Bruce Jenner wrongful death lawsuit.  Jenner was involved in a rear end collision in Malibu, California that resulted in the death of the driver of the vehicle he hit.  California laws of civil procedure allow a defendant being sued to file motions that allege that the facts stated in a complaint (or lawsuit) are not sufficient to state a legal cause of action.  The issue here is whether or not the plaintiff’s, who are stepchildren of the decedent, were “financially dependent” upon the decedent for essential expenses.

Grants to be Awarded to Encourage State and Local Governments To Promote Pool Safety and Combat Drownings and Drain Entrapments

CPSC expects to award $1 million in 1-year grants in FY 2016 to reduce deaths and injuries from drowning and drain entrapments in pools and spas.

Every summer hundreds of children and even some adults drown in swimming pools.  The causes can be many but, are usually due to inattention by supervising parents, poor safety equipment, dangerous drains or other similar causes.  It is good to see that grants are being made to help promote pool safety and reduce these tragic drownings.

Tracy Morgan settles suit with Wal-Mart over fatal delivery truck crash

NEWARK, N.J. (AP) — Actor-comedian Tracy Morgan has settled his lawsuit against Wal-Mart over a highway crash that killed one man and left Morgan and two friends seriously injured. Morgan suffered head trauma, a broken leg and broken ribs and is still recovering. The truck driver, Kevin Roper, of Jonesboro, Georgia, faces several criminal charges, including death by auto, in state court. According to a criminal complaint, Roper was operating the truck without having slept for more than 24 hours. A preliminary investigation by the National Transportation Safety Board estimated that Roper was driving 65 mph in the minute before he slammed into Morgan’s limo van on the New Jersey Turnpike.

Not surprising to see that this case has now been fully resolved with all parties including Tracy Morgan and his associated, who died in the incident.  On average about 95% of all civil cases for personal injury or wrongful death resolve by way of a settlement. This is due to the risks and costs associated with proceeding to trial and facing an adverse judgment, appeals and other costly and time consuming judicial proceedings.

If the allegations in this lawsuit are true, this is a tragic example of neglect and improper care of a mental health patient.
