Seizure-prone driver hit with another lawsuit in fatal crash

When does gross recklessness go from being negligent to being criminal?  When someone gets behind the wheel after being forbidden to do so due to a medical condition which causes him or her to be unable to safely operate a motor vehicle this can and should be charged as a crime.  In addition, it shows a reckless disregard for the safety of other drivers and would entitle the plaintiff’s to punitive damages in addition to compensation for their injuries.
