A sex-abuse lawsuit against the Boy Scouts of America survived a legal challenge Friday and is set for trial later this year in California.
Again, we see the all too familiar sexual abuse claim scenario of a community organization that normally does much good leaving a person of authority in charge of children and that person using their position to sexually exploit the victim. In this case, the perpetrator was an Eagle Scout who has now been criminally convicted of the molestation. The question for purposes of this suit and the motion to dismiss the case was whether both the local and national chapters of Boy Scouts should be held accountable for the assault. The judge ruled that there was no material evidence of negligent supervision but, allowed the claims of failing to warn the abused scout to proceed against the organizations.
