This is a good discussion from a California Highway Patrol officer about the legal rights of drivers and pedestrians with respect to crosswalk right of ways.  The bottom line is that the driver must yield to a pedestrian lawfully in the crosswalk but, the person on foot also has an obligation not to cross the roadway until it is safe to do so.  In reality, the California Vehicle Code sections come down to common sense on the part of the motorist and the pedestrian.
