Michael Jackson wrongful death suit will go to jury, judge rules

The judge rejected AEG Live’s request to dismiss the Michael Jackson wrongful death lawsuit, but two executives were dropped as individual defendants Monday.

Steven M. Sweat‘s insight:

Looks like the Michael Jackson wrongful death lawsuit against AEG Entertainment will go to the jury.  The judge overruled a motion to dismiss the claim.  This type of motion is called a “Motion for Non-Suit” under California law (See California Code of Civil Procedure 581c).  The standard for granting such a motion is that, despite all the evidence presented during trial, the facts are not sufficient to sustain the claims made. These motions are rarely granted.
